Can Chief Election Commissioner Gyanesh Kumar be removed?

As opposition parties demand Chief Election Commissioner Gyanesh Kumar’s resignation, here’s how India’s Constitution actually allows a CEC to be removed. Under Article 324(5), the process requires a removal notice signed by at least 100 Lok Sabha MPs or 50 Rajya Sabha MPs, addressed to the Speaker or Chairman.

If accepted, a three-member panel, including a Supreme Court judge or CJI, a high court chief justice and a legal expert, investigates the charges. Only if it finds grounds for misconduct does Parliament debate the matter, requiring a two-thirds majority in both houses before the President’s approval. No CEC has ever been removed this way; some parties tried in March-April 2026.
